Terms of Service & Liability Waiver

These Terms of Service (“Terms”) govern your use of Ninety9 Degrees Inc.’s services, classes, and website. By booking a class, creating an account, signing a waiver, or entering our facility, you agree to these Terms.

1. Eligibility
You must be at least 16 years old to participate in classes. 

​

2. Health and Safety
By participating, you acknowledge that fitness classes involve inherent risks, including but not limited to muscle strain, joint injury, falls, equipment-related accidents, and cardiovascular stress.
You agree that you are physically capable of safely participating and will disclose any relevant health concerns to the instructor prior to class.

3. Assumption of Risk
You voluntarily assume all risks associated with participation in physical activity at Ninety9 Degrees, whether known or unknown.

4. Release of Liability
To the fullest extent permitted by law, you release and discharge Ninety9 Degrees Inc., its owners, employees, independent contractors, and representatives from any and all liability for injuries, damages, or losses arising from participation in classes or use of studio facilities, except where caused by gross negligence or wilful misconduct.

5. Indemnification
You agree to indemnify and hold Ninety9 Degrees harmless from any claims arising from your participation in classes or use of the studio.

6. Class Policies

• All purchases, including memberships and class packs, are final and non-refundable unless required by law.

• Late cancellations or no-shows may result in forfeited classes or fees, as outlined in our cancellation policy.

• For safety reasons, entry may be denied if you arrive more than 5 minutes late for class.

7. Behaviour & Conduct
You agree to follow all instructor directions, studio guidelines, and safety protocols. Disruptive or unsafe behaviour may result in removal from the studio or termination of services.

8. Memberships & Payments
Memberships may automatically renew based on the terms selected at purchase. Pricing may change with reasonable notice. Payment information is processed securely by third-party providers.

9. Personal Belongings
Ninety9 Degrees is not responsible for lost, stolen, or damaged personal belongings.

10. Accounts Created Through Mariana Tek
By creating an account, you agree to provide accurate information and maintain the confidentiality of your login credentials. You are responsible for all activity under your account.

11. Intellectual Property
All branding, class materials, programs, written content, designs, and media published by Ninety9 Degrees are owned by Ninety9 Degrees Inc. and may not be reproduced without permission.

​

12. Governing Law
These Terms are governed by the laws of Ontario, Canada.
